1. GENERAL
1.1 These Terms and Conditions govern your (the Consumer’s) relationship with this website and/or mobile application (hereafter referred to as the “Service”) that is operated by Lig & Lewe Mediese Sentrum Inc. (Registration Number: 2020/223805/21) t/a Lig & Lewe Kosmeties.

1.2 Our Service allows you to purchase natural skin care and related cosmetic products (hereafter referred to as the “Products”) online.

1.3 Please read through these Terms and Conditions carefully before making use of our Service / purchasing our Products.

1.4 Your access to and use of the Service is conditional upon your acceptance of and compliance with the Terms & Conditions contained herein.

1.5 These Terms & Conditions apply to all visitors, users and others who access or make use of the Service.

1.6 By accessing or making use of the Service, you agree to be bound to these Terms & Conditions.

1.7 If you prefer not to be bound to these Terms & Conditions, you are not entitled to make use of our Service.

2. PRICING & PAYMENT
2.1 Lig & Lewe Kosmeties, at its sole discretion and at any time prior to a sale / payment transaction, may modify the pricing of any Products that are sold through this Service.

2.2 A valid payment method, including credit card payment, is required to process the payment for any Products purchased through this Service.

2.3 You shall provide Lig & Lewe Kosmeties with accurate and complete billing information, including full name, address, state, zip code, telephone number, and valid payment method information if so required.

2.4 By submitting such payment information, you automatically authorize Lig & Lewe Kosmeties to charge the purchase prices of any Products ordered by you, as well as any courier fees that may apply to the delivery of such Products / purchase, to any such payment instruments.

2.5 Should any card transaction fail to occur for any reason, Lig & Lewe Kosmeties may issue an electronic invoice, indicating that you must process a manual payment (cash / EFT deposit) on or before a specified deadline date in order for your transaction to be completed.

3. RETURNS & REFUNDS
3.1 Any sealed / unopened Products that are purchased through this Service may be returned within 7 (seven) calendar days since date of delivery thereof, subject thereto that you are prepared to stand in for any courier fees that may become due and payable in respect of such return.

3.2 The purchase price paid for Products that are returned in accordance with the provision provided for in clause 3.1 above, shall be refunded within 21 (twenty-one) calendar days after the returned goods have been delivered to the physical address of Lig & Lewe Kosmeties as nominated from time-to-time.

3.3 Should any unsealed / opened product sold through this Service be returned to Lig & Lewe Kosmeties due to an allergic reaction or similar occurrence, certain refund requests may be considered by Lig & Lewe Kosmeties on a case-to-case basis and be granted at the sole discretion of Lig & Lewe Kosmeties.

4. USE & COLLECTION OF PERSONAL INFORMATION
4.1 When making use of this Service, you have to provide us with certain personal identifiable information that will allow us to contact or identify you.

4.2 Personal identifiable information may inter alia include, but not be limited to the following:

4.5 Failure to provide us with information that is accurate, complete, and current constitutes a breach of this Terms & Conditions, which may result in the immediate termination of the rendering of our Service and your transaction / purchase.

4.6 By purchasing Products through this Service, you grant us the right and license to use, store and process any Personal Information that you submit to Lig & Lewe Kosmeties in accordance with the provisions of the Protection of Personal Information Act, No. 4 of 2013 for the specific purpose of selling the Products that are made available for online purchase through this Service.

4.7 You acknowledge and warrant that:

4.7.1 the Personal Information submitted through this Service is your own, alternatively, that you have the right to use it and grant us the rights to process such Personal Information in the sale of Products through this Service; and

4.7.2 your submission of Personal Information does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any third party.

5. SECURITY SAFEGUARDS
5.1 The security of your Personal Information is important to us, but we must make it clear that no method of transmission over the internet, or method of electronic storage is 100% secure.

5.2 While we strive to use commercially acceptable means to protect your Personal Information, we cannot and will not guarantee its absolute security.

5.3 You are responsible for safeguarding any PIN-code, password or CVV-code (hereafter “Security Code”) that you use to attend to any online purchase or to access this Service, whether your Security Code is guarded by our Service or by a third-party service.

5.4 You agree not to disclose your Security Code to any third-party and to notify us immediately upon becoming aware of any breach of security or unauthorised use of any account associated with your Security Code.

6. INTELLECTUAL PROPERTY
6.1 The Service and its original content (excluding information / content provided by its users), features and functionality are and will remain the exclusive property of Lig & Lewe Kosmeties and its licensors.

6.2 The Service is, subject to any applicable foreign legislative provisions, protected by copyright, trademark, and other applicable laws of the Republic of South Africa.

7. DISCLAIMER
7.1 You confirm that you acknowledge and understand that most of the Products sold through this Service do not contain any non-natural preservative agent and have a limited shelf life of 6 (six) to 12 (twelve) months since the date of manufacturing thereof.

7.2 You further acknowledge and understand that all Products purchased through this Service should be applied to the inner arm and tested for a period of at least 24 (twenty-four) hours in order to ensure that no allergic reaction occurs before proceeding to apply said Product to the face or body.

7.3 You are making use of this Service, as well as the Products sold through this Service at your own and sole risk.

7.4 The Service, as well as the Products sold through this Service, is provided on an “AS IS” and “AS AVAILABLE” basis.

7.5 The Service, as well as the Products sold through this Service, is subject to applicable legislation, provided without warranties of any kind, whether of an express or implied nature, including, but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

7.6 Lig & Lewe Kosmeties, its subsidiaries, affiliates, and its licensors do not warrant that:

7.6.1 the Service will function uninterrupted, secure or be accessible at any particular time or location;

7.6.2 any errors or defects will be corrected;

7.6.3 the Service is free of viruses or other harmful components; or

7.6.4 the results from using the Service will meet your requirements and/or expectations.

8. LIMITATION OF LIABILITY & INDEMNITY
8.1 In no event shall Lig & Lewe Kosmeties or its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from

8.1.1 your access to use or use of or inability to access or use the Service;

8.1.2 any conduct or content of any third party on the Service;

8.1.3 any content and/or Product acquired / obtained through the Service.

9. LINKS TO OTHER WEBSITES / THIRD-PARTY SERVICES
9.1 This Service may contain links to third party websites or services that are not owned or controlled by Lig & Lewe Kosmeties.

9.2 Lig & Lewe Kosmeties has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party websites or services.

9.3 You further acknowledge and agree that Lig & Lewe Kosmeties shall not be responsible or liable, either directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such third party websites or services.

10. LOG DATA
10.1 Log Data refers to information that is made available to Lig & Lewe Kosmeties via your internet device while making use of this Service, whether by way of a web browser or through a mobile device.

12.4 These Terms & Conditions constitute the entire agreement between Lig & Lewe Kosmeties and the Consumer regarding this Service and the Products to be purchased through this Service, and supersede and replace any prior agreements we might have between us regarding the Service.

13.1 Lig & Lewe Kosmeties reserve the right, at its sole discretion, to modify or replace these Terms & Conditions at any time.
